Your work is yours. If it shows up here without your permission, this page says how to tell us and what happens next.

Draft: This page is a working draft for the pilot. It will change as GallerySpark grows.

The short version

  • Work here belongs to the artist who made it. Posting on GallerySpark transfers no rights to us and none to anyone else.
  • If your work appears without your permission, tell us. You do not need an account. Use the feedback page and link to the work.
  • The artist always hears about a complaint and can answer it. Nothing here is decided in silence.
  • An account that keeps posting other people's work gets closed.

How to make a complaint

Send it through the feedback page and include:

  • your name and an email address where we can reach you
  • a link to the work on GallerySpark
  • what the work is and what your right in it is — you made it, you own it, or you act for the person who does
  • one sentence saying you believe in good faith that this use is not permitted

A complaint with those four things in it gets acted on. If something is missing, we write back and say what we need.

What happens next

  • We read the complaint promptly. If it is complete, we may hide the work while we look into it.
  • We tell the artist who posted the work, and we pass the complaint along.
  • The artist can answer with their own claim: the work is theirs, or they used it with permission, and what supports that.
  • If the answer settles it, the work goes back up or stays down, and both sides hear the outcome from us.
  • If it does not settle, the dispute is between the claimant and the artist. We keep the work hidden while it is unresolved and we follow a court's direction.

If a complaint names your work

A complaint is a claim, not a verdict. It means someone says they hold a right in the work. Answer through the notice we send you and say what supports your side. Silence leaves the work hidden, so it is worth answering.

Repeat infringement and bad faith

One mistake is a conversation. A pattern is not: an account that repeatedly posts work belonging to someone else is closed.

The same honesty runs the other way. A complaint sent in bad faith, for work the sender has no right in, breaks the rules of this page, and we may decline to act on it.
